Professor on Kenya's withdrawal from the International Criminal Court


In a recent op-ed in the Los Angeles Times, Victor Peskin, associate professor in the School of Politics and Global Studies at Arizona State University, collaborated with UC Berkley’s Eric Stover to explore the possible ramifications of Kenya’s withdrawal from the International Criminal Court.

The final decision on whether or not to withdraw is in the hands of President Uhuru Kenyatta and Deputy President William Ruto, both of whom are set to stand trial with the court on charges of crimes against humanity in connection with their alleged role in massacres after the 2007 Kenyan elections.

“If Kenya and other African states head for the exit, it would deal a severe blow to the ICC,” the article states.

The result could be a weak prosecution case against Kenyatta and Ruto, thereby reinforcing their claims that the ICC aims to undermine African sovereignty.

The op-ed concludes, “In the months ahead, the ICC – perhaps as much as the Kenyan leaders themselves – will be on trial in the court of international public opinion.”
