Homeowner Advocacy Unit Supreme Court case reported in local media

The appearance of a law student from the College of Law’s Homeowner Advocacy Unit (HAU) before the Arizona Supreme Court on Jan. 24 was reported on KPNX-Channel 12 and in The Arizona Republic.

Third-year law student Frank “Kyle” Robertson represented an amici group comprising the HAU, Southern Arizona Legal Aid and Jean Braucher, the Roger C. Henderson Professor of Law at the University of Arizona.

The case questioned whether homeowners can challenge the foreclosing party’s authority to sell their homes. Robertson addressed issues related to the practical problems that result when homeowners are denied their rights to challenge illegal foreclosures in court.

The state court justices were concerned that ruling in favor would open a floodgate of courtroom battles, according to 12 News. However, Robertson asked that the “doors of the court not be closed to every homeowner in every case.”

“We’re hoping this opinion will come out and clarify who holds what rights and what you need to foreclose so there’s some clarity in the process,” Robertson told reporter Melissa Blasius.

Robertson is a student in the HAU, which opened its doors in August 2011 in response to the foreclosure crisis in Arizona. Student attorneys participating in this clinic provide legal assistance to clients who have been victims of mortgage fraud or face wrongful foreclosure.
