Bender quoted in Fronteras

Paul Bender, professor of law and dean emeritus, recently was quoted in an article by Jude Joffe-Block, senior field correspondent on Fronteras: The Changing America Desk.

The article, “No SCOTUS Review For Alabama Immigration Law,” explores the U.S. Supreme Court decision not to review a provision of Alabama's immigration enforcement law.

Last year, the 11th U.S. Circuit Court of Appeals ruled that the law, which would make it a crime to harbor and transport an unauthorized immigrant, couldn't take effect because it pre-empts federal law.

"If the Supreme Court had granted this case, it would have really sent shockwaves through the community of people interested in immigration laws," Bender said in the article. "It would have suggested they were rethinking their decision in the Arizona case.

"If I were representing the state, I would not think this was a good occurrence that cert was denied," Bender said. "I'm sure they were hoping the Supreme Court would take this case, and they would get a chance to revisit some of these issues in a slightly different context."

Bender teaches courses on U.S. and Arizona constitutional law. He has written extensively about constitutional law, intellectual property and Indian law, and is co-author of the two-volume casebook/treatise, Political and Civil Rights in the United States. Bender has argued more than 20 cases before the U.S. Supreme Court and actively participates in constitutional litigation in federal and state courts.
